1. Agreement to these Terms
These Terms of Service (the “Terms”) are an agreement between you and Speechma (“Speechma,” “we,” “us” or “our”). They govern your access to and use of the website at speechma.com, its free tools (including Text to Speech, AI voices, Voice Cloning, Voice Design, Voice Changer, AI Dubbing, Speech to Text and the Music Studio), our Android app, and any related pages, features and content (together, the “Service”).
By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, our AI Voice & Cloning Policy and our Cookie Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a company, school, nonprofit or other organization, you represent that you are authorized to accept these Terms on its behalf, and “you” includes that organization.
2. Eligibility and children
You must be at least 13 years old to use the Service. If you are under 18 (or the age of legal majority where you live), you may use the Service only with the involvement and permission of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use.
The Service is a general-audience website. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in a manner that would require parental consent under the U.S. Children’s Online Privacy Protection Act (COPPA). If you believe a child under 13 has submitted personal information to us, please contact contact@speechma.com and we will take appropriate steps to delete it. In some countries a higher minimum age applies to consent for data processing; if so, that higher age applies to you.
You may not use the Service if you are barred from doing so under the laws of the United States or any other applicable jurisdiction, or if we have previously suspended or blocked your access.
3. The Service and changes to it
Speechma provides free, browser-based AI tools that turn text into speech, create and transform voices, dub videos, transcribe audio and generate music, sound effects, songs and lyrics. No account or registration is required to use the free tools on speechma.com.
We are continuously improving the Service. That means we may add, change, limit or remove features, voices, languages, file-size limits, usage limits or entire tools at any time, with or without notice. We may also temporarily suspend the Service for maintenance, security or reasons outside our control. Because the free tools are offered at no charge, we are not liable to you for any change, suspension or discontinuation of the Service, except where the law does not allow us to exclude that liability.
Features described on our website, in guides or in marketing materials reflect the Service at the time of writing and may not always match the current version exactly.
4. Free access, fair use and security codes
To keep the Service free and available for everyone, we may apply usage limits to prevent abuse. These can include maximum text lengths, maximum file sizes and durations, and a short security code that must be entered before each generation. Current requirements are shown in each tool and may change over time.
You agree not to circumvent, disable or interfere with these limits or with any security feature. For example, you may not use scripts, bots, rotating IP addresses, multiple devices or automated captcha-solving services to get around these limits, and you may not access the Service through any automated means other than the official Speechma API.
We may use technical measures to detect and prevent abuse, and we may throttle, block or suspend access from any device, network or IP address that we reasonably believe is violating these Terms or placing an unreasonable load on our systems.
5. Paid products are covered by separate terms
Speechma also offers paid products that are separate from the free tools on speechma.com:
- SpeechmaPRO.com at speechmapro.com, a premium website with 10,000 characters per conversion, no captcha, no ads and no waiting. SpeechmaPRO.com is governed by its own terms, policies and pricing published on that site.
- Speechma API at speechma.com/api/, a developer service with monthly subscription plans and API keys. Your use of the API and any purchase is governed by the terms presented when you sign up and by the API Refund Policy.
If the terms of a paid product conflict with these Terms, the paid product’s terms control for that product. These Terms do not create any obligation for you to pay for anything; the free tools on speechma.com are provided at no charge.
6. Your inputs
“Inputs” means anything you submit to the Service, such as text, scripts, prompts, lyrics, voice descriptions, audio recordings, voice samples, songs, videos, files and links. You retain whatever rights you already hold in your Inputs.
You represent and warrant that:
- you own your Inputs or have all rights, licenses, consents and permissions needed to submit them and to have them processed as described in these Terms;
- your Inputs, and our processing of them to provide the Service, will not infringe or misappropriate anyone’s copyright, trademark, privacy, publicity, voice or likeness rights, or any other right; and
- your Inputs are lawful and comply with our Acceptable Use Policy.
You grant Speechma and the infrastructure partners that help us operate the Service a worldwide, non-exclusive, royalty-free, temporary license to host, transmit, copy, process, analyze and transform your Inputs solely as necessary to produce the result you requested, to keep the Service secure and to comply with law. As explained in our Privacy Policy, uploaded files are not stored on Speechma servers after processing, and we do not use your Inputs to build a profile of you or to sell to anyone.
7. Outputs and your license to use them
“Outputs” means the audio, speech, voices, transcripts, music, sound effects, lyrics, dubbed videos and other results the Service generates for you based on your Inputs.
Your license. Subject to your compliance with these Terms, the Acceptable Use Policy and the rights of third parties, Speechma grants you a worldwide, non-exclusive, perpetual, royalty-free license to use, copy, edit, publish, distribute and monetize your Outputs for any lawful personal or commercial purpose. That includes YouTube and social videos, podcasts, audiobooks, online courses, advertisements, apps, games, presentations and phone systems. No attribution to Speechma is required, although it is always appreciated.
No ownership claim. Speechma does not claim ownership of your Outputs. To the extent any rights in an Output belong to Speechma, we assign or license them to you as described above. Please note that the law on whether AI-generated material can be protected by copyright is still developing and varies by country, so we cannot promise that any Output is eligible for copyright protection or that you will be able to stop others from using similar material.
Similar outputs. AI systems may produce the same or similar Outputs for different users, especially from similar prompts. Your license does not give you exclusive rights in Outputs generated for other people.
Third-party rights still apply. Your license to Outputs does not override anyone else’s rights. If your Input contains copyrighted lyrics, a song, a video or someone’s voice, the Output may still be subject to those rights, and you are responsible for obtaining any permission you need.
Your responsibility. You are solely responsible for reviewing Outputs before you use them, for how you use them, and for any disclosures that may be required (for example, disclosing AI-generated or synthetic media where a platform, advertiser or law requires it).
8. Voice cloning, voice changing and consent
Tools that reproduce or transform a voice, including Voice Cloning, Voice Changer and AI Voice Cover, carry special responsibilities. You may use them only with a voice that is your own, or a voice whose owner has given you clear, informed permission to clone or transform it for the purpose you intend. Permission to record someone is not the same as permission to clone their voice.
You may not use these tools to impersonate a real person, including celebrities, public figures, politicians, family members or colleagues; to make anyone appear to say something they did not say; or to deceive listeners about who is speaking. Additional rules are set out in our AI Voice & Cloning Policy, which forms part of these Terms.
9. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. In summary, you may not use the Service to commit fraud or impersonation; create deceptive deepfakes of real people; spread election or civic misinformation; harass, threaten or defame anyone; create sexual content involving real people without consent or any content sexualizing minors; produce illegal content; send spam or make robocalls that violate the Telephone Consumer Protection Act (TCPA) or similar laws; distribute malware; scrape or overload the Service; or bypass usage limits or security codes.
We may remove access to, refuse to process, or report any content or activity that we reasonably believe violates these Terms or the law, and we may cooperate with law enforcement and rights holders where appropriate.
10. Advertising
The free Service is supported by advertising, including ads served by Google AdSense. By using the free Service, you agree that ads may be displayed alongside or within the tools and pages. Ads may be personalized or non-personalized depending on your location, your consent choices and your Google ad settings. You can learn more and manage your choices on our Your Privacy Choices page and in our Cookie Policy.
Ads are provided by third parties. Speechma does not endorse, and is not responsible for, the products, services or claims of advertisers. Any dealings you have with an advertiser are solely between you and that advertiser. You agree not to use ad blockers in a way that interferes with the functioning of the Service, and not to generate fraudulent ad impressions or clicks.
11. Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, and the choices and rights you have. In short: we do not require an account, uploads are processed to produce your result and are not stored on our servers afterward, your history and settings are kept in your own browser, and advertising and analytics are provided by Google. By using the Service you acknowledge the practices described in the Privacy Policy.
12. Speechma’s intellectual property
The Service and everything that is part of it, other than your Inputs and Outputs, are owned by Speechma or its licensors and are protected by copyright, trademark and other laws. This includes the Speechma name and SPEECHMA wordmark, logos, website design, software, code, voice catalog, text, guides, graphics and the selection and arrangement of content.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not copy, modify, frame, mirror, resell, sublicense or create derivative works of the Service; reverse engineer, decompile or attempt to extract the source code or underlying models of the Service, except where applicable law expressly permits it; remove proprietary notices; or use our name, logos or trademarks without our prior written permission. All rights not expressly granted are reserved.
13. Feedback
We welcome ideas, suggestions, bug reports and other feedback about the Service (“Feedback”). If you send us Feedback, you grant Speechma a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without restriction or compensation to you. Feedback is voluntary, and we are not obligated to use it or to keep it confidential, so please do not include confidential or personal information you do not want shared.
14. Third-party links and services
The Service may contain links to third-party websites, apps, platforms and services, including advertisers, Google’s policy pages, app stores and websites you paste as links for processing. We do not control and are not responsible for third-party sites or services, their content, their availability, or their privacy and security practices. Your use of them is at your own risk and subject to their own terms. A link does not mean we endorse the third party.
When you submit a link (for example, to a video or audio file) for processing, you are responsible for making sure that you have the right to access and process that content and that doing so does not violate the terms of the website hosting it.
15. Copyright complaints (DMCA)
Speechma respects the intellectual property rights of others and expects users to do the same. If you believe that content available on or through the Service infringes your copyright, please follow the process in our Copyright & DMCA Policy, which describes how to send a notice under the Digital Millennium Copyright Act (17 U.S.C. §512), how to submit a counter-notice, and our policy on repeat infringers. Notices should be sent to contact@speechma.com with the subject line “DMCA Notice.”
16. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, SPEECHMA DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the above, we do not warrant that the Service will be uninterrupted, timely, secure or error-free; that Outputs will be accurate, complete, suitable for your purpose or free of mispronunciations, transcription errors or artifacts; that any particular voice, language or feature will remain available; or that the Service will be free of viruses or other harmful components. AI-generated material can be wrong, and transcripts, lyrics and translations should be checked by a person before you rely on them. Nothing on the Service is professional, legal, medical or financial advice. See our Disclaimer for more.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SPEECHMA OR ITS OPERATORS, CONTRIBUTORS, PARTNERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY OUTPUT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, SPEECHMA’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE FREE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
These limitations apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, such as liability for fraud, for death or personal injury caused by negligence, or for gross negligence or willful misconduct where the law does not permit a limitation.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Speechma and its operators, contributors and partners from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your Inputs; (b) your use of Outputs; (c) your violation of these Terms, the Acceptable Use Policy or the AI Voice & Cloning Policy; or (d) your violation of any law or of any third party’s rights, including intellectual property, privacy, publicity and voice rights. We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.
19. Suspension and termination
You may stop using the Service at any time. Because there are no accounts on speechma.com, you can simply stop visiting the website and clear your browser’s stored Speechma data if you wish.
We may suspend, restrict or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or the law, if your use creates risk or possible legal exposure for us or others, or if we discontinue the Service. Sections that by their nature should survive termination will survive, including Sections 6 (the license you granted for processing already performed), 7, 12, 13, 16, 17, 18, 20 and 22.
20. Governing law and resolving disputes
Talk to us first. Most concerns can be resolved quickly and informally. Before filing any claim, you agree to contact us at contact@speechma.com with a short description of the issue and the outcome you want, and to give us at least 30 days to try to resolve it in good faith. We will do the same before bringing any claim against you.
Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws applicable at the operator’s place of business, without regard to conflict-of-law rules.
Where disputes are heard. If a dispute cannot be resolved informally, it will be resolved by the competent courts of the jurisdiction where the operator has its place of business, unless the law where you live gives you the right to bring the claim in your local courts. There is no mandatory arbitration under these Terms. Either party may bring an eligible claim in small claims court, and either party may seek urgent injunctive relief from any competent court to protect intellectual property or prevent abuse of the Service.
Your mandatory consumer rights. If you are a consumer, nothing in these Terms takes away rights you have under the mandatory consumer protection laws of the country or state where you live, including any right to bring proceedings in your local courts or to complain to a consumer protection authority.
21. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the Service, new legal requirements or feedback. When we do, we will change the “Last updated” date at the top of this page and, for material changes, we will make reasonable efforts to give notice, such as a notice on the website. Changes take effect when posted unless we say otherwise. If you continue to use the Service after the updated Terms take effect, you accept them. If you do not agree to the changes, you must stop using the Service.
22. General terms
- Entire agreement. These Terms, together with the policies they incorporate, are the entire agreement between you and Speechma about the free Service and replace any prior agreements on that subject.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in full effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, such as outages of internet or hosting infrastructure, natural disasters, labor disputes or government action.
- Export and sanctions. You agree to comply with all applicable U.S. and international export control and sanctions laws in your use of the Service.
- Notices. We may give you notices by posting them on the Service. Legal notices to Speechma must be sent by email to contact@speechma.com.
- Headings. Headings are for convenience only and do not affect interpretation. “Including” means “including without limitation.”
- Language. These Terms are written in English. If we provide a translation, the English version controls to the extent permitted by law.
